TERMS AND CONDITIONS OF USE OF THE CHATBOT IA, PRIVACY AND COOKIES POLICY

The following terms and conditions of use are intended to inform users about the limitations, guidelines and conditions of use of the artificial intelligence based chatbot provided by DigitalPA.

Please read these terms and conditions of use carefully before interacting with the automated response system (Chatbot).

GENERAL INFORMATION

The automated answering system (Chatbot) represents an additional support service made available by DigitalPA with the sole purpose of providing users with information and assistance regarding the use of the offered software and services.

The Automated Response System (Chatbot) exploits artificial intelligence (AI) computer technology powered by OpenAI through the provider Chatling and enables 24/7 assistance.

The answers processed and provided by the Chatbot system have as their only source DigitalPA's internal acts and documents or acts, documents, information and communiqués coming from Anac or other institutional bodies, in any case always in the public domain.

OPERATION, CONDITIONS AND MODALITIES

It is important to remember that the answers provided are all automatically generated and are not a substitute for expert advice.

Although we endeavour to provide accurate information as accurately as possible via the AI Chatbot system, we cannot guarantee

- the accuracy, completeness or up-to-date nature of the information provided;
- that the chatbot understands your request and provides you with correct answers/information;
- the flawless operation of the chatbot, for any errors or deficiencies that may occur during use.
- that the chatbot will always function flawlessly and provide accurate information;
- that the use of the chatbot will replace any expert.

Therefore, we encourage you to verify any information provided by the chatbot before taking any action or making any decision based on the information received.

It is always recommended that you carry out adequate supervision and take appropriate safeguards to mitigate potential risks associated with the use of Artificial Intelligence (i.e. impacts on a person's fundamental rights, health or safety).

In the event that the automatic response provided appears to be inaccurate or unsatisfactory, the user shall always have the right to request assistance using the ticket, telephone and email channels, if included in the contract.

The information provided by the chatbot system does not represent the positions or opinions of DigitalPA.

RIGHTS AND RESPONSIBILITIES

DigitalPA assumes and accepts no responsibility or liability whatsoever with regard to the information provided or the accuracy and/or completeness thereof and in no event shall DigitalPA be liable for any damages or losses that may result from the use of the Chatbot system or from the misunderstanding and use of information obtained through the use of the Chatbot system.

In using the automated response system, you understand and agree, at your own risk and under your own responsibility, that it may return content, materials, data, insights, information and other results that are inaccurate or otherwise unsuitable for use (including from a legal and/or commercial point of view), and that DigitalPA makes no warranty, express or implied, that automated responses are free from error or bias.

You are solely responsible for such results, which are also your ‘Content’ for the purposes of these Terms.

You are also solely responsible for the use of the results and you agree to carefully examine such results before using or relying on them and to ensure that everything is accurate, lawful and otherwise appropriate and not harmful.

You understand and agree that the answers provided by the Chatbot system are intended solely for the purpose of improving the use of the software and/or obtaining assistance with respect to the services offered by DigitalPA, and are not intended for any other or further use. The User therefore assumes all responsibility for using the answers in any other way and/or for exploiting the content in other contexts than the one for which it is intended.

It is understood that the User is and remains responsible for all decisions taken, advice given, choices made, actions taken and/or failure to act based on the use of Artificial Intelligence and agrees to indemnify and hold harmless DigitalPA from any civil and/or criminal and/or administrative liability that may arise therefrom.

The user is also aware and accepts that only the text of the conversation (question and answer), may be stored and processed by DigitalPA in order to improve the effectiveness of the Chatbot system, so that over time it may provide more and more adequate, complete and relevant answers to the users' requests.

DigitalPA expressly reserves the right to change, add or delete individual or all functionalities of the Chatbot system without prior notice, or to temporarily or permanently discontinue the Chatbot system. DigitalPA provides no guarantee for the continued accessibility of the Chatbot system. DigitalPA is not obliged to provide the Chatbot system for a certain period of time.

PRIVACY AND DATA SECURITY

We prioritise the privacy and security of our users' information.

In any case, we urge you not to share sensitive, personal or confidential information in your conversations and in general in your interaction with the Chatbot system, as it is not required and not necessary for the proper use and purpose of the service.

The Chatbot system does not ask you to provide personal information, nor does it automatically collect personal information. Within the scope of this service, neither navigation data nor other personal or sensitive data is saved. For the sole purpose of continuously improving the service, DigitalPA reserves the right, and the user accepts, to store only the text of the conversation (question and answer), excluding any reference to the user or data referring to the user.

DigitalPA for the use and exploitation of the automated response system makes use of the services of artificial intelligence (acronym AI) powered by OpenAI via the provider Chatling. Chatling ensures adequate organisational, infrastructure, product and data security and privacy as well as appropriate internal security and data management procedures. COOKIES

No personal user data is implicitly acquired by the portal via cookies.

Cookies are not used to transmit information of a personal nature, nor are persistent cookies used to track users. Only technical cookies are used, which do not allow profiling and identification of individuals. The use of session cookies (which are not permanently stored on the user's computer and disappear when the browser is closed) is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to enable the safe and efficient exploration of the portal.

Third-party technical cookies - Chatling
The platform uses the ‘Chatling’ service, the automated response system (Chatbot) exploits artificial intelligence computer technology (acronym AI) powered by OpenAI through the provider Chatling and allows for 24/7 assistance.

The use of this technology involves the installation of essential cookies by the third-party company Chatling. However, the platform does not share any browsing information or user data. In any case, the User can disable/delete third-party cookies directly from their browser settings. Cookies are indispensable for the use of the Chatling service. If cookies are disabled, the service will not function.

FINAL PROVISIONS

By using the Chatbot AI system, you indicate your acceptance and understanding of this terms and conditions document and the disclaimer in favour of DigitalPA contained herein. If you do not agree with the contents of this document, please refrain from any use of the Chatbot system.
